    Important Reminders


    1. Authority to File Applications: An application for development review or approval must be filed by the person having legal authority to take action. Unless otherwise expressly stated, that person is presumed to be the (1) record owner, (2) purchase under a sale from the record owner, or (3) the duly authorized agent of the record owner. City officials are authorized to require proof of legal authority to take the action sought.
    2. Filing Fees: Applications must be accompanied by the non-refundable fee established by the Comprehensive Fee Schedule. 
    3. Complete Applications: Applications that do not include all required information/plans and/or are not accompanied by the required fees will be returned to the applicant as incomplete and no further processing will occur.



    Zoning Map Amendment (Rezone)

     To change the zoning district classification of your property, you must take an application to the Salina City Planning Commission. The City Planning Division processes the application and can assist in determining the most appropriate zoning district for the intended use.

    Zoning Text Amendment 

    To proceed with filing an application for amendment to the zoning text, a narrative dictating the proposed new text must be attached to this application.

    Conditional Use Permit

     Some uses may be desirable when located in the community but may be incompatible with other uses in the permitted zoning district. Therefore, the Planning Commission may authorize, as an exception to City of Salina code, the establishment of a conditional use in a particular zoning district.

    Subdivision Plat

    The primary purpose of a preliminary plat is to show the layout of streets, alleys, lots, blocks, and other elements of a subdivision. 

    The primary purpose of a final plat is to delineate property boundaries and to describe and dedicate rights-of-ways and easements. It is the map or plan or record of a subdivision.

    Planned Development District

     The application of flexible land use is often difficult or impossible with traditional zoning district regulations. In order to allow more flexible land use regulations and to facilitate use of the most advantageous techniques of land development, the Planning Commission is authorized to establish planned development districts in which the zoning regulations are in harmony with the general purpose and intent of this chapter and with the comprehensive plan of the city.

    The process for a PDD has two steps: preliminary and final.

    Special Use Permit (Open Air Market)

     A special use permit may be issued by the Planning Commission for the operation of open air markets, including outdoor flea markets, farmer's markets or roadside produce stands after the Commission has held a public hearing in accordance with the procedures established in Section 42-24 of the Salina Code, subject to specific provision.

    Variance / Appeal

    A variance is permission granted by the Board of Zoning Appeals to waive or alter a requirement of the zoning ordinance. The BZA can adjust the standards of the zoning ordinance where exception l and extraordinary circumstances apply to a property.

    An appeal is permission granted by the Board of Zoning Appeals to alter a decision made by the Zoning Administrator.

    Certificate of Compatibility

    A Certificate of Compatibility must be applied and approved before the following work activities can take place: 

    • Constructing; demolishing; or changing the existing exterior design, material, color, texture, finish, or appearance of any building or any other improvement to real property in the Business Improvement District; 
    • Introducing, changing, substituting, or removing any physical feature affecting the appearance of real property in the Business Improvement District.

    Sidewalk Dining Café License Agreement

    A Sidewalk Dining Area is permitted for restaurants within the Lee District having facilities, equipment, and manner and hours of operation of which are consistent with a food service operation, including but not limited to the types of business establishments customarily referred to as cafes, cafeterias, coffee shops, dairy bars, restaurants and soda fountains. Drinking establishments within the Lee District whose gross receipts from the sale of food for consumption on the premises are more than thirty percent (30%) on an annual basis are permitted to have sidewalk dining areas.

    Sidewalk Signs & Outdoor Furniture 

    Apply for a Downtown ACE District Outdoor Merchandise Area to place signs, furniture, merchandise, etc. on the sidewalk DURING business hours.

    Temporary Use Permit

    A temporary use permit is required for the sale of goods and/or services by an individual, a business or a company that will occur outside of a building or on a vacant lot for a brief period of time. Specific regulations can be found in Chapter 42-59 of the Salina Municipal Code.

    License Agreement

    A license agreement permits a private party to encroach upon or construct site improvements within a public property or right-of-way. The agreement authorizes an owner or tenant to construct physical improvements within the public right-of-way.
