ORDINANCE NUMBER 24-11200
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings.
The following findings support the annexation of the property described in Section 2 by the City of Salina:
1. The property is the site of a proposed commercial subdivision that wishes to receive City utilities and services.
2. Annexation is being requested by the property owner in order to allow the property to connect to existing City water and sewer lines and receive City police and fire protection.
3. The property is located in the City’s Urban Service Area and is contiguous to the existing city limits on the east, southeast, and north.
Section 2. Annexation. The following legally described tract, meeting one or more of the classifications of annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas:
A portion of the South Half of Section 2 and the North Half of Section 11, Township 15 South, Range 3 West of the 6th Principal Meridian, Saline County, Kansas, being described by Jason R. Loader, PS 1462 on March 7, 2024 as follows:
Commencing at the South Quarter Section corner of said Section 2, thence on the south line of the Southeast quarter of said Section2, S 89°57'17" E 149.12 feet to the Northeast Corner of Water Well Road right-of-way per Yost Addition to the City of Salina, said point also being the point of beginning; thence on the east line of said Water Well Road right-of-way, S 00°02'43" W 102.77 feet to a point on the South right-of-way line of said Water Well Road; thence on said South right-of-way line, N 81°25'45" W 52.22 feet; thence continuing on said South right-of way-line, N 89°56'18" W 1110.65 feet; thence N 00°04'02" E 95.10 feet to the intersection of the South line of said Section 2 and the centerline of Dry Creek; thence along said centerline, N 35°12'33" E 680.11 feet; thence continuing along said centerline, N 17°50'40" E 440.42 feet; thence continuing along said centerline, N 10°08'51" W 489.31 feet; thence continuing along said centerline, on a curve to the left, having a radius of 1561.91 feet, an arc length of 1252.83 feet, and a chord which bears, N 12°36'19" E 1219.51 feet to a point on the North line of the Southwest Quarter of said Section 2; thence on said North line, S 89°58'15" E 311.56 feet to the center corner of said Section 2; thence on the North line of the Southeast quarter of said Section 2, S 89°57'53" E 1269.69 feet to the Westerly right-of-way line of Interstate 135; thence on said westerly right-of-way line, on a curve to the left, having a radius of 5579.65 feet, an arc length of 95.48 feet, and a chord which bears, S 10°42'43" W 95.48 feet; thence continuing on said westerly right-of-way line, S 11°05'33" W 399.95 feet; thence continuing on said westerly right-of-way line on a curve to the left, having a radius of 5879.65 feet, an arc length of 844.67 feet, and a chord which bears, S 07°01'22" W 843.95 feet; thence continuing on said westerly right-of-way line, S 01°38'16" W 266.25 feet to the northern point of a tract described in Deed Book 392, Page 706 recorded in the Saline County Register of Deed; thence on the westerly line of said described tract, S 09°06'14" W 361.65 feet; thence continuing on said westerly line, S 21°59'18" W 647.12 feet; thence continuing on said westerly line, S 81°30'07" W 192.95 feet; thence continuing on said westerly line, N 85°42'32" W 380.40 feet to the Northeast corner of a tract described in Book 1034, Page 1341 in said Register of Deeds Office; thence on the East line of said described tract, S 13°22'13" W 42.59 feet; thence continuing on said East line, S 00°02'37" W 58.42 feet to the South line of said Southeast Quarter of said Section 2; thence on said South line, N 89°57'17" W 40.93 feet to the point of beginning. All bearings herein are based on an assumed bearing of S 89°57'17" E on the South line of said Southeast Quarter.
Contains 97.05 acres, more or less.
Section 3. Zoning. All property described in Section 2 shall be classified as lying in an A-1 (Agricultural) zoning district upon annexation.
Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the property described in Section 2 are hereby repealed.
Section 5. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 6. Effective date. This ordinance shall be in full force and effect from and after publication.
