Municipal Court
Yes. The process followed in Salina Municipal Court is found in K.S.A. 12-4516 and K.S.A. 12-4516a. Court staff cannot provide legal advice about whether you qualify or any other legal matters. If you have questions about the benefits of expungement or whether you qualify, you may want to consult with a private attorney. The Court will not appoint an attorney to represent you in requests for a record to be expunged. For more information and the forms that can be used, click here.
You may choose to be represented by an attorney in all municipal court cases. If you are charged with an offense that carries the possibility of jail time, you have the right to be represented by an attorney. You must hire your own attorney, unless you meet the criteria to qualify as indigent and ask the Municipal Court Judge appoint one for you. To ask the Judge to appoint an attorney for you, you must complete the financial affidavit for appointed defense services.
When you appear for your first appearance, you may request that the Court schedule a pretrial hearing, which will be a designated time for you to speak with the City Prosecutor about your case. If you are represented by an attorney, the prosecutor will not discuss your case with you.
We gladly accept cash, checks, money orders, and most major credit cards. Individuals that have presented a worthless check to the Salina Municipal Court in the past, must submit payments by cash, money orders, or credit cards. Click here for more information and payment locations.
You can contact the Salina Municipal Court at (785) 833-8590 between the hours of 8:00 a.m. - 5:00 p.m., Monday through Friday or by e-mailing the Court Services Officer Amanda Swolensky. If you have missed your appointment, you will need to contact the Court Services Officer to reschedule.
If you suspect that you have a warrant for your arrest, there are options available to resolve the problem. Warrants for minor traffic infractions and time to pay issues can often be canceled upon payment in full. Other cases require an appearance before the judge. Prior to your court date and time, you may submit a copy of your insurance card to the Municipal Court. Your insurance information will be accepted electronically, by fax, or in person. Generally, a person can do community service work at a local non-profit organization for credit towards their fine. The Municipal Court has a list of locally approved agencies. Click here for more information. Also, the person that has the payment arrangement with the court may appear before the Judge during the Back-Up docket.
Once you have paid your fines and reinstatements fees that information is sent to the state of Kansas. It usually takes 7-10 days for processing. You may check the status of your driver's license by contacting the Kansas Department of Revenue (DMV-Topeka) at (785) 296-3671 or going to their website at https://www.kdor.org.
When the Court Services Officer files a Motion to Revoke an Affidavit is also filed on your case. The Affidavit will provide you the reasons why and programs that where not completed. If you are not able to appear in court on the date your hearing has been scheduled, you will need to appear on the Back-Up docket prior to that court date.
