RESOLUTION NO. 25-8295
A RESOLUTION AMENDING RESOLUTON NO. 23-8115; DETERMINING THE ADVISABILITY OF THE MAKING OF CERTAIN INTERNAL IMPROVEMENTS IN THE CITY OF SALINA, KANSAS; MAKING CERTAIN FINDINGS WITH RESPECT THERETO; AND AUTHORIZING AND PROVIDING FOR THE MAKING OF THE IMPROVEMENTS IN ACCORDANCE WITH SUCH FINDINGS (STREET/WATER/DRAINAGE/SANITARY SEWER IMPROVEMENTS/CEDAR POINT ADDITION).
WHEREAS, pursuant to K.S.A. 12-6a01 et seq. (the “Act”), the City of Salina, Kansas (the “City”) has previously adopted Resolution No. 23-8115 (the “Prior Resolution”) determining the advisability of making certain internal improvements (the “Improvements”) and assessing the costs thereof as described therein; and
WHEREAS, the governing body of the City finds that is is necessary and advisable to amend the Prior Resolution to provide for an equitable distribution of the costs of certain of the Improvements.
THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS:
Section 1. Amendment. Section 1(e) of the Prior Resolution is hereby amended as follows:
(e) The apportionment of the cost of the Improvements between the Improvement District and the City-at-large is:
(1) 100% of all costs of the the Improvements, other than the costs attributable to the curbing, guttering, pavement, and grading of approximately 520 lineal feet of Cedar Point Place, shall be assessed against the Improvement District and 0% to be paid by the City-at-large; and
(2) 0% of the costs of the Improvements attributable to the curbing, guttering, pavement, and grading of approximately 520 lineal feet of Cedar Point Place shall be assessed against the Improvement District and 100% paid by the City at large.
Section 2. Ratification. The rest and remainder of the Prior Resolution is ratified and approved.
Section 3. Effective Date. This Resolution shall be effective upon adoption. This Resolution shall be published one time in the official City newspaper, and shall also be filed of record in the office of the Register of Deeds of Saline County, Kansas.
