ORDINANCE NUMBER 26-11299

 

AN ORDINANCE OF THE CITY OF SALINA, KANSAS, AMENDING CHAPTER 19 OF THE SALINA CODE, PERTAINING TO THE SALINA, KANSAS LIBRARY AND RESTATING CHAPTER 19 AS FOLLOWS.

 

WHEREAS, the Salina Public Library Board is established pursuant to K.S.A. 12-1219; and

 

WHEREAS, the Salina Public Library Board has periodically revised and updated its bylaws to reflect the Board’s current practices and governance standards; and

 

WHEREAS, Chapter 19 of the Salina Municipal Code has not been correspondingly updated to reflect those revisions; and

 

WHEREAS, it is appropriate to amend the Salina Municipal Code from time to time to maintain consistency with the Salina Public Library Board Bylaws; 

 

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:


Section 1. Amendment, Restructuring, and Restatement. Salina Code Chapter Nineteen – “Library” is amended, restructured, and restated to read as follows:


Chapter 19

LIBRARY

 

Sec. 19-01. Use of the Library.

The library shall be free to the use of inhabitants of the city, subject always to reasonable rules and regulations as the library board may adopt, and the board may exclude from the use of the library any and all persons who shall willfully violate such rules.


Sec. 19-02. Library Property and Materials.

It shall be unlawful for any person to permanently remove without returning or to damage library materials or property. All items borrowed from the library must be returned as required by rules the library board may adopt.


Sec. 19-03. Library Board Composition.

The library board shall consist of seven (7) appointed members and the mayor as an ex officio member. The mayor, as an ex officio member of the library board, shall have the same powers as appointed members. The mayor shall, as terms expire or vacancies occur, appoint, with the approval of the board of commissioners, members of the library board.


Sec. 19-04. Library Board Terms.

No person who has been appointed for two (2) consecutive four (4) year terms on the library board shall be eligible for further appointments to such board until two (2) years after the expiration of the second term. Vacancies on the library board occasioned by removal from the city, resignation, or otherwise, shall be filled by appointment for the unexpired term. Regular terms of members of the library board shall be for four (4) years, ending April thirtieth.


Sec. 19-05. Library Board Qualifications and Requirements.

No person holding any office in the city shall be appointed a member of the library board while holding such office. All members appointed to the library board shall be residents of the city. Members of the library board shall receive no compensation for their services as such but shall be allowed their actual and necessary expenses in attending meetings and carrying out their duties as members.


Sec. 19-06. Library Board Responsibilities.

The library board shall constitute a body corporate and politic, processing the usual powers of a corporation for public purposes, under the name and style of “The Board of Directors of the Salina Public Library” and under such name may contract, sue, and be sued, and acquire, hold and convey real and personal property in accordance with law.


The library board shall:



  1. Annually elect a chairman, secretary and treasurer as well as other officers as deemed necessary by the board.
  2. Fix the date and place of its regular meetings. Special meetings may be called by the chairman or upon written request of a majority of the members.
  3. Members shall be provided notification, stating the time, place and agenda of any special meeting of the library board.
  4. All Library Board meetings shall be held in compliance with the Kansas Open Meetings Act (K.S.A. 75-4317 et. sq. or its successor).



Sec. 19-07. Library Board Powers and Duties.

The library board shall be responsible for general operation and oversight of the library and shall make and adopt rules and regulations for the administration thereof. The library board is responsible for employing a Director that is accountable for the day-to-day operations of the library.


The library board shall:


  1. Make decisions regarding the acquisition or disposition of real property of significant value;
  2. Purchase or lease a site or sites and to lease or erect a building or buildings for the use of the library;
  3. Establish and maintain a library or libraries and outreach library service within the city or within any other municipality with which service contract arrangements have been made;
  4. Make annual reports to the state librarian and the board of commissioners of the city as required;
  5. Bond the treasurer of the library board as required by statute. Such bond shall be filed with the city clerk.
  6. Require the library Director to publish an annual budget approved by the board for the maintenance and support of the free public library in the same manner as required by law applying to other taxing units. All applicable laws must be followed in regards to the library budget and mill levy.



Section 2. Repealer. Existing Salina Code Chapter Nineteen is repealed.


Section 3. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.


Section 4. Effective date. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
