ORDINANCE NUMBER 26-11298
AN ORDINANCE PROVIDING FOR THE ANNEXATION AND ZONING OF CERTAIN TRACTS OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Application. James Hall, on behalf of Great Plains Manufacturing, Inc., has filed an application requesting the annexation of 27 acres of land in relation to the following described tract of real estate:
Lot Seven (7), Lot Eight (8), and Lot Nine (9) in Brown & Brown Addition to the City of Salina, Saline County, Kansas and those parts of Dillingham Avenue, Hensley Street, and Gregory Avenue that abut said Lot Seven (7), Lot Eight (8) And Lot Nine (9) and that part of Lot 5 in Brown & Brown Addition to the City of Salina, Saline County, Kansas that is North of the South 404.86 Feet of said Lot 5, and East of the West line of the Southeast Quarter (Se 1/4) of the Northeast Quarter (Ne 1/4) of Section Seven (7), Township 14 South, and Range 2 West of the 6th P.M. (the “Property”).
Section 2. Findings. In relation to the Property, the Governing Body makes the following findings:
- The land adjoins the city and a written petition for voluntary annexation was filed with the City pursuant to K.S.A. §12-520(a)(7).
- Annexation is being requested by the property owner to bring their land holdings into the City of Salina, establishing congruent Heavy Industrial (I-3) zoning with their existing adjacent campus, and to facilitate the future vacation of remaining unbuilt rights-of-way.
- The subject property is located in the City's Urban Service Area and has adequate public facilities available to support the annexation, including existing water and sanitary sewer lines.
Section 3. Annexation. The Property, meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas.
Section 4. Zoning. The Property described in Section 1 above shall be classified as lying in an I-3 (Heavy Industrial) zoning district upon annexation, which is consistent with its current Saline County zoning classification and the abutting City zoning classification.
Section 5. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance.
Section 6. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 7. Effective date. This ordinance shall be in full force and effect from and after its adoption and publication once by summary in the official city newspaper.
