ORDINANCE NUMBER 24-11229
AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 24-11214 AS IT AMENDED ORDINANCE NO.R 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY, TO CORRECT THE LEGAL DESCRIPTION SET FORTH IN SECTION 1 OF ORDINANCE NO. 24-11214; REPEALING EXISTING SECTION 1 OF ORDINANCE NO. 24-11214; AND RATIFYING AND AFFIRMING ALL OTHER SECTIONS OF ORDINANCE NO. 24-11214 AS TO THE CORRECTED LEGAL DESCRIPTION.
WHEREAS, after the adoption of Ordinance No. 24-11214 by the Governing Body of the City of Salina, Kansas on July 22, 2024; its signature by the Mayor on July 22, 2024; and its publication on July 23, 2024, a survey error was discovered causing the need for a correction of the legal description of the tract of real estate (referred to as the “Property”) to be rezoned as set forth in Section 1 of Ordinance No. 24-11214 by amendment of Section 1 of Ordinance No. 24-11214 pursuant to and in the manner prescribed by K.S.A. 12-3004; THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Amendment of Section 1 of Ordinance Number 24-11214. To correct the error in the legal description set forth in Section 1 of Ordinance No. 24-11214 and to conform with the plat of Airport Industrial Center No. 3 Subdivision, Section 1 of Ordinance No. 24-11214 is amended to read as follows:
Section 1. Application. The Salina Airport Authority has filed Application #Z24-3 requesting a change in zoning district classification from Saline County AG (Agricultural) to I-3 (Heavy Industrial) in relation to the following described unplatted tract of real estate:
The North half of the Northeast quarter (N ½ NE ¼) of Section Ten (10), Township Fifteen (15) South, Range Three (3) West of the 6th principal meridian, in Saline County, Kansas, being more particularly described as follows:
Beginning at the Northeast corner of said Northeast quarter, thence S 00° 13’ 49” E, along the East line of said North half, a distance of 1325.08 feet to the Southeast corner of said North half; thence S 88° 29’ 42” W, along the South line of said North half, a distance of 2667.10 feet to the Southwest corner of said North half; thence N 00° 38’ 13” E, along the West line of said North half, a distance of 1320.60 feet to the Northwest corner of said Northeast quarter; thence N 88° 23’ 06” E, along the North line of said Northeast quarter, a distance of 2647.23 feet to the point of beginning (now platted and known as the Airport Industrial Center No.3 Subdivision);
Containing 3,513,246.9 square feet or 80.65 acres, more or less.

Section 2. Repealer and Reaffirmation. Section 1 of Ordinance No. 24-11214 is repealed and all other sections of Ordinance No. 24-11213 are ratified and affirmed as to the corrected legal description as set forth in Section 1 of this ordinance.
Section 3. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 4. Effective date. This ordinance shall be in full force and effect from and after publication.
