ORDINANCE NUMBER 24-11228
AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO. 24-11213 AS IT PROVIDED FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE, TO CORRECT THE LEGAL DESCRIPTION SET FORTH IN SECTION 2 OF ORDINANCE NO. 24-11213; REPEALING EXISTING SECTION 2 OF ORDINANCE NO. 24-11213; AND RATIFYING AND AFFIRMING ALL OTHER SECTIONS OF ORDINANCE NO. 24-11213 AS TO THE CORRECTED LEGAL DESCRIPTION.
WHEREAS, after the adoption of Ordinance No. 24-11213 by the Governing Body of the City of Salina, Kansas on July 22, 2024; its signature by the Mayor on July 22, 2024; and its publication on July 23, 2024, a survey error was discovered causing the need for a correction of the legal description of the tract of real estate to be annexed as set forth in Section 2 of Ordinance No. 24-11213 by amendment of Section 2 of Ordinance No. 24-11213 pursuant to and in the manner prescribed by K.S.A. 12-3004; THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Amendment of Section 2 of Ordinance Number 24-11213. To correct the error in the legal description set forth in Section 2 of Ordinance No. 24-11213 and to conform with the plat of Airport Industrial Center No. 3 Subdivision, Section 2 of Ordinance No. 24-11213 is amended to read as follows:
Section 2. Annexation. The following legally described tract, meeting one or more of the classifications of annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas:
The North half of the Northeast quarter (N ½ NE ¼) of Section Ten (10), Township Fifteen (15) South, Range Three (3) West of the 6th principal meridian, in Saline County, Kansas, being more particularly described as follows:
Beginning at the Northeast corner of said Northeast quarter, thence S 00° 13’ 49” E, along the East line of said North half, a distance of 1325.08 feet to the Southeast corner of said North half; thence S 88° 29’ 42” W, along the South line of said North half, a distance of 2667.10 feet to the Southwest corner of said North half; thence N 00° 38’ 13” E, along the West line of said North half, a distance of 1320.60 feet to the Northwest corner of said Northeast quarter; thence N 88° 23’ 06” E, along the North line of said Northeast quarter, a distance of 2647.23 feet to the point of beginning;
Containing 3,513,246.9 square feet or 80.65 acres, more or less.
Section 2. Repealer and Reaffirmation. Section 2 of Ordinance No. 24-11213 is repealed and all other sections of Ordinance No. 24-11213 are ratified and affirmed as to the corrected legal description as set forth in Section 1 of this ordinance.
Section 3. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 4. Effective date. This ordinance shall be in full force and effect from and after publication.
