ORDINANCE NUMBER 24-11196
AN ORDINANCE AMENDING ORDINANCE NUMBER 8526, CODIFIED AS CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP OF THE CITY OF SALINA, KANSAS BY REZONING AND PRESCRIBING THE PROPER USES OF CERTAIN PROPERTY WITHIN THE CITY.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Application. 1858 Properties, LLC, has filed Application #Z23-12 requesting a change in zoning district classification from R-3 (Multi-Family Residential) district and C-3 (Shopping Center) district to C-4 (Central Business) district in relation to the following described real estate:
Lot One Hundred Seventy (170) and Lot One Hundred Seventy-Two (172) on Santa Fe Avenue and Lot One Hundred Sixty-Nine (169) and the North Ten (10) feet of Lot One Hundred Seventy-One (171) on Seventh Street, plus the vacated alley right-of-way south of Mulberry Street abutting the above described lots, in the Original Town (now City) of Salina, Saline County, Kansas (the “Property”)
Section 2. Findings. In relation to the Property, the Governing Body makes the following findings:
- All conditions precedent for the amendment of the City’s Zoning District Map and the rezoning of the Property have been timely met;
- Due to the changing conditions in the surrounding area, the vacant corner lot at 7th Street and Mulberry Street is more suitable for commercial use than continued residential use and the current R-3 zoning inhibits the reuse of this property; and
- There is C-4 zoning north and east of the Property and a change in zoning classification to C-4 would be consistent with the existing zoning pattern and would not adversely affect the surrounding area.
- The Property is located in the Downtown Business Improvement District and adjacent to the Downtown land use area in the Comprehensive Plan and C-4 is identified as a potential zoning district in the Downtown land use area.
- Rezoning the Property to allow for additional accessory parking to support a downtown restaurant is consistent with the Comprehensive Plan’s goal of encouraging infill development in Salina’s “Core Downtown” and surrounding “Downtown Neighborhoods” and making Downtown a “park once” destination.
Section 3. Amendment. DISTRICT “C-4” CENTRAL BUSINESS. The Zoning District Map of the City of Salina, Kansas is amended to rezone the Property as part of DISTRICT “C-4” CENTRAL BUSINESS.
Section 4. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance.
Section 5. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 6. Effective date. This ordinance shall be in full force and effect from and after publication.
