RESOLUTION NUMBER 24-8248
A RESOLUTION DECLARING GLENIFFER HILL PARK AS SURPLUS AND AUTHORIZING ITS SALE PURSUANT TO AND IN ACCORDANCE WITH K.S.A. 12-1301.
WHEREAS:
- Gleniffer Hill Park is a 1.65-acre parcel of land legally described on the attached and incorporated Exhibit A;
- Gleniffer Hill Park amenities include an approximately 5,100 square foot playground and an asphalt basketball court, both of which are located in the south approximately one-half acre of the parcel, while the remaining approximately 1.15 acre area of the parcel is an undeveloped open field;
- Indian Rock Park is a 34.6-acre park that adjoins Gleniffer Hill Park to the south (across Gypsum Avenue) currently with amenities including public restrooms, shelter house, Indian Rock Lodge, and hiking trails, but no playground equipment;
- The City of Salina the (“City”) has 26 designated parks and 29 designated playground units within those parks;
- The City has developed a playground replacement schedule and has identified an on-going funding source for implementation of that playground replacement schedule;
- The north end of Indian Rock Park has been identified as a proposed location for a new and larger approximately 8,000-square foot playground with access to public restrooms without the need to cross a city street;
- Gleniffer Hill Park is regarded as one of Salina’s least utilized parks with approximately 1.15 acres of the 1.65-acre park remaining undeveloped and under-utilized for years;
- It is proposed that Gleniffer Hill Park be declared as surplus property, be sold by the City pursuant to K.S.A. 12-1301, and made available for redevelopment through a “request for proposals” process to be conducted by the City, with dedication of the net sale proceeds in combination with existing City budget funds to construct a new, expanded and improved playground offering to the immediate neighborhood and the community-at-large without appreciably lessening park offerings to the neighborhood or community;
THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. Pursuant to K.S.A. 12-1301, the City elects to declare surplus and offer for sale the parcel of land commonly known as Gleniffer Hill Park pursuant to a “request for proposals” process with dedication of the net proceeds to be combined with City budget funds for the construction of a playground at the north end of Indian Rock Park.
Section 2. In accordance with K.S.A. 12-1301, the City Clerk is directed to publish this Resolution on the City website as the City’s official newspaper once each week for two consecutive weeks upon the same day of the week.
Section 3. If within thirty (30) days from the date of the last publication there has not been filed with the City Clerk a protest signed by qualified electors of the City equal in number to not less than ten percent (10%) of the electors who voted at the last preceding regular city election as shown by the poll books, the City may make such sale pursuant to the terms of this Resolution. In the event such a petition is filed with the City Clerk within the time prescribed above, no such sale shall be made until the Governing Body of the City shall be instructed so to do by a majority of all the votes cast on the proposition at a regular or special election.
