ORDINANCE NUMBER 26-11295
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF LAND IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Findings. The following findings support the annexation of the property described in Section 2 by the City of Salina:
- The property is the site of a large multi-family residential development that has requested to be served by City infrastructure including streets.
- Annexation is being requested by the property owner to comply with locally adopted fire codes requiring a secondary entrance for large multifamily developments.
- The property is located in the City’s Urban Service Area and is contiguous to the existing city limits.
Section 2. Annexation. The following legally described tract, meeting one or more of the classifications of annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, is hereby annexed and made a part of the City of Salina, Kansas:
A tract of land located in the Southwest Quarter of the Northeast Quarter of Section 35, Township 14 South, Range 3 West of the Sixth Principal Meridian, Saline County, Kansas, written by John F. Harvey P.S. 1426, on June 6, 2025, and more particularly described as follows:
Commencing at the center corner of said Section 35;
Thence on an assumed bearing of North 00° 04’ 57” West on the west line of the Northeast Quarter of said Section 35, a distance of 19.94 feet to the north line of the south twenty feet of said northeast quarter and the point of beginning;
Thence North 00° 04’ 57” West on said west line, a distance of 910.24 feet to the south line of Magnolia Commons Addition, an Addition to the City of Salina, Saline County, Kansas;
Thence North 89° 54’ 09” East, a distance of 50.00 feet to the southwest corner of Lot 4, Block 1, of said Magnolia Commons Addition;
Thence South 00° 04’ 57” East, a distance of 910.39 feet to the north line of the south twenty feet of the Northeast Quarter of said Section 35;
Thence North 89° 55’ 27” West, a distance of 50.00 feet to the Point of Beginning.
Said Tract contains 45,516 square feet more or less.
Section 3. Zoning. All property described in Section 2 shall be classified as lying in an A-1 (Agriculture) zoning district upon annexation.
Section 4. Repealer. That all prior ordinances in conflict herewith as they relate to the property described in Section 2 are hereby repealed.
Section 5. Publication. The City Clerk shall cause this ordinance, as soon as practicable after it has been passed and signed, to be published on the City’s website as the designated official city newspaper.
Section 6. Effective date. This ordinance shall be in full force and effect from and after publication.
